DO ELSBYS SOLICITORS WORK ON A NO WIN-NO FEE BASIS?

Yes. All cases are conducted under a no win-no fee agreement unless a client has suitable legal expenses insurance.

WHAT IS LEGAL EXPENSES INSURANCE AND HAVE I GOT IT ALREADY?

Legal Expenses Insurance (LEI) covers the legal fees in a claim. This includes payments to cover court or expert fees and any adverse award of legal costs. LEI is now available on most car policies and on many home insurance policies. Some credit cards also provide cover as an extra benefit. We will make enquires about its availability on your behalf.

WILL ELSBYS SOLICITORS BE ABLE TO ACT FOR ME UNDER MY LEI POLICY?

Almost certainly. Many insurance companies sub-contact their legal expenses work to specialist providers such as Mondial and Capita and ELSBYS SOLICITORS act for clients under these LEI policies and from other large organisations such as the AA; the RAC and Tesco Insurance.

MY OWN INSURANCE COMPANY HAS ALREADY APPOINTED SOLICITORS – DO I HAVE TO USE THEM?

No. There is an EU Directive that requires every citizen to have the freedom to choose their own solicitor for court work. Most LEI providers accept that this includes all injury claims, even if the case does not actually go to court. Don’t forget that the appointed panel solicitors will have a commercial arrangement with the LEI provider. In other words, they will pay directly or indirectly for your case referral. ELSBYS SOLICITORS are wholly independent of the insurance industry.

I AM NOT HAPPY WITH MY CURRENT SOLICITORS – CAN I CHANGE?

Yes. There is usually no problem with this.

SO, WHAT WILL IT COST ME TO MAKE A CLAIM?

Nothing. We have always passed 100% of the compensation to every client.

With no win-no fee, or LEI, all the legal costs are taken care of. If we win, the legal costs will claimed from the Defendant’s insurance company - on top of the compensation.

If the case is “lost” the legal costs will be covered by any LEI policy. Under a no win-no fee agreement, we will not receive any payment for our work, and any adverse order for costs will be covered under a separate insurance policy that will take out for you.

WHY SHOULDN’T I USE ONE OF THOSE COMPANIES THAT ADVERTISE ON THE TELLY?

Most of these companies are not solicitors at all but claims “farmers” who provide cases in bulk to large legal firms for a fee. The companies are often run by middlemen who are likely refer you to a firm of solicitors that you know nothing about; who run many of the cases by a “team” or with personnel who have no legal qualifications; and whose offices may be hundreds miles from your home.
